Ryan S. Suser, a Member and Litigation Attorney, recently won an appeal before the New York State Appellate Division for the Third Department. The win affirms a decision favoring Ryan’s client. It allows the sale of an interest in vacation property over another party’s objection. The question before the Court was whether the property’s owner – a trust – could sell it with the support of a majority of trustees but over the objections of another. The Appellate Division affirmed the lower court in all respects.
