Bousquet Holstein attorney Ryan Suser recently won a decision on summary judgment finding that the opposing party had breached certain terms of a separation agreement.
Ryan’s client was divorced pursuant to this agreement that required the parties to continue living together. After some time, Ryan’s client moved out and the question became whether the agreement could force her to continue making payments on the home.
Ryan brought an action seeking partition and breach of contract. Following discovery, the court awarded summary judgment requiring the home to be sold and awarding legal fees and other damages.
